Don't pay up front.
Pay just for plea bargain; that's what you'll likely get to begin with.
If you decide to go to trial later, negotiate the additional cost. Before getting the $7000 fee Kapsack talked only about aquittal after trial; after he pocketed the money it was all about how great the plea offer was.
